Copyright: transfer

An owner of intellectual property (IP) rights, including copyright, may sell its rights. Upon payment of the purchase price, ownership is then transferred, so that the purchaser becomes the new rights holder. A deed is required for the transfer of ownership of IP rights.

A legally valid transfer of ownership is based on two pillars: a title of transfer and a deed of delivery. Step 1 is that a title of transfer is required for a valid transfer. This is a legal obligation to transfer ownership. An example of this is a contract of sale. However, the contract of sale does not yet make the buyer the owner. Step 2 is required for this. A deed of transfer, in which the IP rights are actually transferred to the buyer. Once the deed of transfer has been signed, the buyer becomes the new holder of the IP rights.
